Join the FLSA Collective Action

If you meet the eligibility requirements to participate in the FLSA Collective Action (see FAQ 3) and want to be included, you must complete and sign the Consent Form. You can fill out the Consent Form electronically here, or you can return the completed blue form in the postage prepaid, pre-addressed envelope that was mailed to you with the Notice, see FAQ 5.

Opt Out of the IMWL and IWPCA Class Action

If you meet the eligibility requirements for either the IMWL or IWPCA class (see FAQ 3) you are automatically included in the Class Action. If you want to be excluded, you must complete and sign the Exclusion Form. You can fill out the Exclusion Form electronically here or you can return the completed red form in the postage prepaid pre-addressed envelope that was mailed to you with the Notice, see FAQ 6.

Do Nothing

FLSA Collective Action: If you do nothing, you will not be able to participate in the FLSA portion of this lawsuit and will not be able to pursue your claim unless you file your own lawsuit within the required time period, see FAQ 5.


IMWL and the IWPCA Class Action: If you meet the eligibility requirements for either the IMWL or the IWPCA class (see FAQ 3) you are automatically included, in the Class Action, and you do not need to do anything, see FAQ 5.
